   going on a training course, taking unfair disciplinary action, or exclusion from company social events.
2.3.4. Positive Action
In specific circumstances, the Company may encourage or offer support specifically to an under- represented group and this ‘positive action’ is allowed under discrimination laws. For example, we may deliver some training in management skills only to women or encourage them to apply/train for driving jobs to increase the representation of females driving our trucks.
2.3.5. Vicarious Liability
Vicarious liability is when a manager, and/or the Company, has responsibility for a colleague’s actions. It applies even when the manager is not there, and whether the incident takes place at work or at any time when the colleague is in the course of their employment, which can include work related social events.
For example, a manager is vicariously liable if one of their colleagues commit an act of discrimination at a works social event, even if they are not personally present when the act takes place.
2.4. RESPONSIBILITIES
Directors and managers have prime responsibilities for all aspects of equality and diversity at work within their respective business units. The Managing Directors of each business area and Functional Directors are responsible for the implementation of this policy.
Managers Must:
Read, understand and follow the principles of this document and any associated document(s);
• Keep up to date with changes to this document and any associated document(s);
• Seek guidance from HR as appropriate;
• Notify HR if any training is required;
• Ensure that this policy is correctly applied and complied with at all times;
 • Display this policy in all UK places of work;
• Deal with any complaint received seriously and in accordance with this policy;
• Set standards of behavior, role model appropriate behavior and ensure these
standards are adhered to within their area of responsibility;
• Take corrective action when behavior falls short of acceptable standards;
